Fatal-Accident-ChicagoAugust 22, 2013. NOT GUILTY IN FATAL ACCIDENT.  Lewis Gainor defended his client against charges he killed another person in an accident on the Eisenhower Expressway. A jury returned a verdict of not guilty. Circuit Court of Cook County. Daley Center. Chicago. Case No. M2501689.

July 31, 2013. CASE DISMISSED. Client was arrested for retail theft at the mall by officers of the Schaumburg Police Department and taken into custody. At the police station, she admitted to the offense by signing a confession. Nonetheless, after presenting mitigation to the prosecutor (eg, reasons for a lesser punishment), the Cook County State’s Attorney agreed to dismiss all charges. Circuit Court of Cook County. 3rd Municipal District Court in Rolling Meadows. Case No. 13 MC 300**** (case number omitted because it is subject of petition to expunge and seal).

July 26, 2013. CASE DISMISSED. In this matter, the client was arrested and taken into custody for domestic battery. The complaining witness was found with injuries and photos were taken. The defendant demanded trial and all charges were dismissed. Circuit Court of Will County in Joliet. Case No. 13 CM 1437.

July 3, 2013. EXPUNGED. In this case, the client was arrested by officers from the Rockford Police Department for domestic battery concerning a dispute with her husband. She had filed for divorce and in retaliation, he called the police and made accusations to get her arrested. In terrible misfortune, she was held for bond hearing over a holiday weekend, so she spent several nights in jail unnecessarily. All charges were dismissed, and the court ordered all records in the case completely expunged. Circuit Court of Winnebago County. Case No. 13 CM **** (case number not disclosed because that was defeat the purpose of expungement).

June 25, 2013. NOT GUILTY. Client was acquitted of domestic battery despite testimony from witness that she was battered and photographs of injuries. Circuit Court of Cook County. Case No. 13 DV 7218701. First Municipal District (Chicago, Domestic Violence Building).

June 10, 2013. CASE DISMISSED. This client was accused of domestic battery. The arresting officer responded to a 911 distress call and found the complaining witness with injuries. She accused the client and he was arrested for domestic battery. On the first court date, the complaining witness appeared in court and the State indicated it would proceed with the prosecution. (In Cook County, if the victim doesn’t appear on the first appearance date, most cases are dismissed. This was the opposite.) Nonetheless, all charges were dismissed after demanding trial. Circuit Court of Cook County. Rolling Meadows (3rd Municipal District). Case No. 13 DV 30262.

May 24, 2013. NOT GUILTY. In this case, the client was charged with DUI and possession of drug paraphernalia. He was stopped for a traffic violation and his vehicle was searched after a K-9 detected the odor of cannabis. A digital scale was located in his pocket and a grinder in center console.  Not guilty on all counts. Circuit Court of Boone County. Case No(s). 12 DT 122, 12 CM 351.

December 28, 2012. CASE DISMISSED. Client was arrested after a traffic stop on I-290 near Chicago. A trooper searched him and found drug paraphernalia and cannabis. The judge agreed with Lewis Gainor that there was no probable cause and threw the case out. Circuit Court of Cook County. Maywood. Case No. 12 MC 400137801.

June 6, 2012. DRIVING WHILE SUSPENDED DISMISSED. Lewis Gainor was representing this client on a DUI matter in Skokie. Not aware that his driver’s license was suspended, the client drove and was arrested by the Chicago Police Department for driving while license suspended (minimum 10 days jail). Case dismissed. Circuit Court of Cook County. First Municipal District Court. (Daley Center). Case No. TW-493-563.

June 5, 2012. NOT GUILTY OF FELONY DRIVING WHILE REVOKED. Client who had supervision on DUI was re-sentenced to a conviction and his license revoked. Later he was arrested by Chicago Police Department for driving while license revoked, and charged with a Class 4 felony. Not guilty at trial. Circuit Court of Cook County, Criminal Division. 26th and California. Case No. 11 CR 2124501. (Coincidentally, Lewis Gainor was able to have this client’s DUI supervision reinstated and thus, his license was reinstated by the Secretary of State.)

April 25, 2012. NOT GUILTY OF FELONY (see above). Client was charged with aggravated DUI and held in Cook County jail awaiting trial. It was his third offense. He was found not guilty. Circuit Court of  Cook County. Fourth Municipal District in Maywood. Case No. 11-C4-41299.

March 14, 2012. CONVICTIONS VACATED. CHARGES DISMISSED. Client had been arrested in 2010 for two offenses. His family’s law firm referred him to an attorney who took the case. He was convicted and lost his driver’s license for one year. He hired Lewis Gainor to re-open the case. All convictions were vacated and the charges were dismissed. March 1, 2012. THEFT CHARGES DISMISSED. Client was arrested for suspicion of trying to steal an automobile from a car dealership. Witnesses came to court to testify against the client at trial. August 30, 2011. Felony charge of possession of cannabis DISMISSED after hearing on motion to suppress evidence. Circuit Court of Grundy County. Case No. 11 CF 39. Client was pulled over by Illinois State Police and the search discovered substantial quantity of cannabis. All charges were dropped after court ruled that search violated the 4th Amendment.
