I got arrested for DUI in Mundelein, Illinois. What is the process?

The Mundelein Police Department makes more DUI arrests for a department of its size than almost any other police department in the state. According to the Alliance Against Intoxicated Motorists (AAIM), Mundelein made 434 arrests for DUI in 2008. In that year, the department had 54 officers on the force. That’s a rate of 8.04 arrests per officer, and the highest rate per officer in all of Lake County.

Further, the total of 434 arrests in 2008 is a 25.4% increase since 2007, which had a total of 346 DUI arrests all year. That 25.4% increase also appears to be the highest increase in Lake County.

The process for a Mundelein DUI starts with an arraignment, which is set by the arresting officer on the traffic ticket. On the arraignment date, the judge will advise the defendant as to the nature of the charges and the possible sentence, and the defendant must enter a plea of guilty to not guilty. A DUI charge in Illinois is a Class A misdemeanor on the first offense. A Class A misdemeanor has a sentence of up to one year in jail. A conviction will cause the Secretary of State to revoke the driver’s license of the defendant.

A driver who is arrested for DUI in Mundelein must take a chemical test to determine blood alcohol content. If the breath test result is above 0.08 or the defendant refuses to blow, his driver’s license will be suspended.

All Mundelein DUIs are assigned at the time of this article to courtroom 405 in the Circuit Court of Lake County. Mundelein DUIs are prosecuted by a private law firm, not the Lake County State’s Attorney.
